1. Agreement to these terms
These Terms of Service govern your access to and use of DermAI, including our website, mobile or web app, AI skin scan features, reports, account tools, subscriptions, referrals, support, and related services.
By using DermAI, creating an account, uploading a scan, starting a subscription, or accessing a report, you agree to these Terms. If you do not agree, do not use DermAI.
Additional terms may apply to payment processors, referral partners, app stores, clinics, or third-party services. If those terms conflict with these Terms for DermAI-operated features, these Terms control unless we state otherwise.
2. Eligibility and accounts
You must be able to form a binding agreement under applicable law. If you are under the age of majority in your location, a parent or legal guardian must manage your use of DermAI.
You agree to provide accurate account information, keep your login secure, and promptly tell us about unauthorized access. You are responsible for activity under your account unless caused by our breach of these Terms.
Family profiles may be used by an account holder to organize scans for household members where the account holder has authority and consent to do so.
- Do not create accounts using false identity information.
- Do not share login credentials with unauthorized people.
- Do not upload someone else's skin image unless you have their consent and authority.
- Do not use DermAI for workplace, insurance, employment, school, immigration, or eligibility decisions.
3. Medical disclaimer
DermAI provides general wellness information, AI-assisted visual pattern review, condition probability estimates, urgency guidance, and appointment-preparation summaries. DermAI is not a medical device unless and until we expressly state that a specific regulated version has been cleared, approved, registered, or otherwise authorized where required.
DermAI does not provide medical advice, diagnosis, treatment, prescriptions, clinician-patient relationships, emergency response, or a guarantee that a condition is present or absent.
Always consult a qualified dermatologist, physician, or emergency service for medical advice, diagnosis, or treatment. If symptoms are severe, spreading quickly, painful, infected, bleeding, changing rapidly, near the eye, accompanied by fever, or otherwise concerning, seek professional care immediately.
Emergency warning
Do not rely on DermAI in an emergency. Contact local emergency services or visit urgent care if you may need immediate medical attention.
4. AI scan limitations
AI outputs are probabilistic and may be inaccurate. Image quality, lighting, skin tone representation in training data, body area, symptom history, camera settings, angle, compression, and incomplete context can affect results.
DermAI may show low-confidence, unsupported, or doctor-soon outputs instead of naming a likely condition. This is a safety feature, not a failure of the service.
You agree not to treat any scan result as a final diagnosis or to delay care because a result appears reassuring. You should compare outputs with symptoms, medical history, clinical advice, and your own judgment.
- DermAI may miss serious conditions, including infection, allergic reactions, autoimmune concerns, or skin cancer.
- DermAI may confuse visually similar conditions.
- DermAI may be less reliable for images with poor lighting, blur, tattoos, makeup, wounds, hair coverage, or private body areas.
- DermAI may not be appropriate for infants, immunocompromised users, pregnant users, complex medical histories, or post-procedure complications.
5. Acceptable use
You may use DermAI only for lawful, personal, and responsible skin-health guidance. You must not misuse the service, attempt to bypass limits, interfere with security, reverse engineer protected systems, scrape content, overload infrastructure, or use DermAI to build competing models or datasets without permission.
- Do not upload illegal, exploitative, explicit, harassing, or non-consensual images.
- Do not upload images of minors unless you are their parent or legal guardian or otherwise have lawful authority.
- Do not submit images that include faces, intimate areas, identity documents, addresses, or other unnecessary personal details.
- Do not use DermAI for diagnosing third parties without consent.
- Do not use DermAI outputs for insurance, employment, legal, eligibility, or high-stakes decisions.
- Do not attempt to manipulate, test, or attack the AI model, payment flow, authentication, or security controls.
6. Free tier, Pro plans, and billing
DermAI may offer a free tier with limited scans and paid Pro plans with additional features such as unlimited scans, top-3 probability breakdowns, scan history, PDF reports, family profiles, or referral pathways.
Plan features, prices, billing cycles, taxes, and promotions may change. We will show the applicable price and billing cycle before purchase. Unless stated otherwise, subscriptions renew automatically until cancelled.
Payments may be handled by providers such as Stripe, app stores, or other checkout processors. You authorize the applicable provider to charge your chosen payment method for subscription fees, renewals, taxes, and authorized purchases.
7. Cancellations and refunds
You can cancel renewal for a paid plan through your account settings, payment-provider flow, app-store subscription settings, or support@dermai.skin where self-service is unavailable.
Cancellation stops future renewal but does not automatically refund the current billing period. Refund eligibility is explained in the Refund Policy and may depend on timing, usage, duplicate payments, failed payments, statutory rights, and processor rules.
8. Referrals, pharmacies, affiliates, and clinicians
DermAI may provide links, referral matching, pharmacy pathways, teleconsult options, dermatologist booking, affiliate offers, or partner content. These features are intended to help you find care or relevant products, but third-party providers are independent from DermAI unless expressly stated.
We do not guarantee appointment availability, clinician quality, prescription decisions, product suitability, pricing, outcomes, or third-party service performance. You should review third-party terms, privacy policies, credentials, and medical advice before relying on them.
9. Content and intellectual property
DermAI, including software, interfaces, models, text, report formats, branding, designs, workflows, and content, is owned by DermAI or its licensors and is protected by intellectual-property laws.
You retain ownership of images, notes, and other content you submit. You grant DermAI a limited license to host, process, transform, display, and use that content as needed to provide the service, support your account, enforce policies, protect security, and improve the service where permitted by law and consent settings.
10. Privacy and data deletion
Our Privacy Policy explains how we collect, use, store, share, and delete personal data. Because DermAI may process skin photos and health-related context, you should review the Privacy Policy before uploading scans.
Account deletion, scan deletion, and consent withdrawal may affect your ability to access scan history, reports, Pro features, referrals, or support investigations.
11. Suspension and termination
We may suspend or terminate access if you violate these Terms, create risk for other users, abuse the service, infringe rights, fail to pay, use DermAI unlawfully, or create security, legal, or operational risk.
You may stop using DermAI at any time. Certain terms, including medical disclaimers, payment obligations, liability limits, intellectual-property terms, dispute provisions, and privacy-related retention rights, may survive termination.
12. Disclaimers and limits of liability
DermAI is provided on an as-is and as-available basis to the fullest extent permitted by law. We do not guarantee uninterrupted access, error-free outputs, medical accuracy, condition detection, clinical outcomes, or that every feature will remain available.
To the fullest extent permitted by law, DermAI will not be liable for indirect, incidental, consequential, special, exemplary, punitive, loss-of-data, loss-of-profit, personal injury, health-outcome, or reliance damages arising from use of the service.
Nothing in these Terms limits liability that cannot be limited under applicable law, or your statutory consumer rights where they apply.
13. Governing posture, changes, and contact
DermAI is built with a U.S.-only commercial launch posture. Specific governing law, venue, and entity details may be updated when DermAI's final legal entity and commercial launch footprint are confirmed.
We may update these Terms as features, laws, prices, partners, or operating models change. Material updates will be communicated through the service, website, email, or another reasonable channel.
